The General Conditions of Contract regulate the distance selling relationship between JOUMMA BAGS SL and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Conditions of Contract, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, in accordance with the provisions of the current regulations on the Protection of Personal Data, Law 7/1996, of 15 January on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

JOUMMA BAGS SL reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. These modifications may be made, through its websites, by any means admissible by law and shall be binding for as long as they are published on the website and until they are validly modified by subsequent modifications. Nevertheless, JOUMMA BAGS SL reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it considers it appropriate, announcing them in due time and form.

The purpose of the website is to offer and advertise suitcases, backpacks, bags and accessories.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.

As a user or customer, you expressly declare that you know, understand and accept the conditions of use and these general contracting conditions. Likewise, you declare that you are of legal age and have the necessary legal capacity to access the websites of JOUMMA BAGS SL and to contract through them.

It is a prerequisite that you register as a user of the website to make the purchase online. You can access the corresponding section for registration on the website itself. In accordance with the provisions of the current regulations on Personal Data Protection, JOUMMA BAGS SL informs users that the personal data collected during the registration process and subsequent purchase, will be entered into a file under its responsibility, in order to process such actions by the user and manage subsequent actions arising from them. In the case of a product on offer, the offer price and the validity of the offer will always be indicated together with its essential characteristics.

In compliance with the regulations in force, JOUMMA BAGS SL offers information about all the articles on sale, their characteristics and prices. Nevertheless, JOUMMA BAGS SL reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the same. In this way, the products offered at any given time on the website will be governed by the General Terms and Conditions in force at any given time. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products.

 

III. Essential product characteristics

The products offered in our online shop, incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph is not binding. It is identified in the characteristics.

IV. Guarantees

Consumers are entitled to enjoy a 3-year legal guarantee for products purchased from 01 January 2022 for material and/or manufacturing defects.

This 3-year warranty is in accordance with the legislative change in art. 16.7 of Royal Decree-Law 7/2021 of 27 April and affects products purchased from 01/01/2022. For products purchased prior to this date, the current legal warranty is 2 years.

The warranty begins on the original date of purchase of your item, the replacement of the product covered by the warranty does not have the effect of extending the initial duration of the commercial warranty.

The warranty covers apparent manufacturing defects that may be interfered with by normal use of the product. However, it does not cover damage caused by external factors such as falls, shocks, fire, burns or external temperatures, negligence, theft, accidents, improper use or modification of the product, normal wear and tear, scratches or damage caused by transport (such as, for example, by airlines).

Joumma Bags is liable for defects of conformity of all products offered on its website within the period provided for by the legislation in force. We have an after-sales service, which will determine whether or not the problem is covered by the Joumma Bags guarantee. If the warranty is applicable, you will be informed whether the product will be repaired or replaced. The cost of repairing the products in question (or the parts) will be borne by Joumma Bags, provided that it is a manufacturing defect. In the event that you wish to repair the product due to damage resulting from an external cause (blow, scratch...), or any other cause caused by the Customer, the costs will be borne by the latter.

In the event that your product is not covered by the guarantee and you wish to have it repaired by us, you can contact us by e-mail at shoponline@shop.joumma.com provided that the parts necessary for the replacement are available.

To use the after-sales service, the customer can visit Joumma Bags' premises, contact us by e-mail at shoponline@shop.joumma.com or go to the point of sale.

To make use of the guarantee, the original purchase receipt or invoice from JOUMMA BAGS SL is essential. If this is not the case, we will not be able to evaluate or process the guarantee.

V. Prices

All products indicate the selling price in Euros and include Value Added Tax (VAT).

If any other tax is applicable, this will be indicated (IGIC or IPSI).

 

VI. Delivery and transport costs

JOUMMA BAGS SL only delivers to the Peninsula, Balearic and Canary Islands.

  • For orders over 39€ the shipping costs are free of charge.
  • For orders destined for the Peninsula (Spain):

- For orders over 39 € (VAT included), shipping costs are free with MRW.

- For orders under 39 €, shipping costs are 3,95 €.

For orders to the Canary Islands, Balearic Islands or other European regions, the customer must contact us beforehand via our contact e-mail shoponline@shop.joumma.com, indicating the following information, the product you wish to purchase (the name / reference number as it appears on the website), postcode, e-mail and address. JOUMMA BAGS SL will contact the customer to send him/her an estimate without obligation.

JOUMMA BAGS SL undertakes to deliver the order within a maximum of 24-48 hours from the day after the order is placed.

For orders to the Balearic Islands the delivery time is 48-72 hours. For other regions of Europe, this is confirmed at the time of preparing the quotation.

VII. Methods of payment and execution of the order

The customer may pay the amount of his order by choosing any of the following methods of payment. During the purchase process you must indicate your choice:

  • VISA or MASTERCARD credit card.

All operations involving the transmission of personal or bank details are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All the information you transmit to us travels encrypted through the network.

Likewise, your credit card details are entered directly on the bank's website, at the bank's POS (Point of Sale Terminal) and are not entered or registered on any JOUMMA BAGS SL server.

When paying by VISA or MASTERCARD, you will always be asked for the following data: the card number, the expiry date, and a Validation Code that coincides with the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

This payment method is only valid on the website.

When theramount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries will be made as soon as possible on the accounts of the supplier and the cardholder.

However, if the purchase had actually been made by the cardholder and the demand for a refund was not the result of exercising the right of withdrawal or termination and, therefore, had unduly demanded the cancellation of the corresponding charge, the cardholder shall be obliged to compensate JOUMMA BAGS SL for the damages caused as a result of said cancellation.

  • Bank transfer

When selecting the bank transfer you will receive, together with the confirmation of your order, an e-mail with the bank details of JOUMMA BAGS SL.

It is very important that when making the transfer you indicate in the subject line the order number, as well as your name and surname, and make the transfer within 3 days after the order confirmation date in order to be able to validate it.

If you wish, you can send us proof of the transfer by e-mail to info@shop.joumma.com. But in any case, the order will not be considered effective until our administration department has received confirmation of the bank transfer.

We would like to remind you that payment must be made in EUROS and that all possible exchange and bank charges are your responsibility.

In therecase of bank transfers made from outside Spain, it is very important that when ordering the transfer you always inform your bank to take charge of the commissions at origin, those bank commissions and expenses corresponding to your bank. Otherwise, JOUMMA BAGS SL could stop the shipment of your order if we do not receive the full amount.

The possible exchange and bank commissions are the responsibility of the customer.

  • Cash on Delivery

If you wish we can send your order cash on delivery, the payment will be made in cash to the carrier at the time of delivery of the order. In this type of payment the carrier applies a commission of 3 €.

  • PayPal

Allows you to send payments on the Internet securely and conveniently. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

The availability of the products offered by JOUMMA BAGS SL may vary depending on customer demand. Although JOUMMA BAGS SL updates the stock periodically, the product requested by the customer could be out of stock at that moment. In the event of non-execution due to unavailability, JOUMMA BAGS SL will notify the customer by e-mail as soon as it becomes aware of this situation. The period of this communication will not exceed a maximum period of 30 days in any case. JOUMMA BAGS SL will be able to give the double option of: supplying the customer with no increase in price, a product of similar characteristics or of superior quality, or except for justified and demonstrable reasons by JOUMMA BAGS SL within this same period, paying the sums paid for the cancelled order. In the event that JOUMMA BAGS SL does not make this payment within the aforementioned period, the purchaser may claim to be paid double the amount owed, without prejudice to his right to be compensated.

VIII. Right of withdrawal, returns and complaints

The purchaser shall have a minimum period of fourteen calendar days to withdraw from the purchase, from the day the customer receives the product, without penalty and without stating the reasons.

The exercise of the right of withdrawal must be notified by telephone to 962361097, by sending an e-mail to info@shop.joumma.com, or by sending a letter to our postal address PG. IND. EL ALTET C/ LA AGRILLENT S/N APTD. 388 46870, ONTINYENT (VALENCIA), or by using the withdrawal form.

According to the provisions of Article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, supplies of services or goods made according to the specifications of the consumer or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

 

IX. The return

JOUMMA BAGS SL will collect the product.

The customer must return or deliver the product directly to JOUMMA BAGS SL, to the address PG. IND. EL ALTET C/ LA AGRILLENT S/N APTD.388 46870, ONTINYENT (VALENCIA), without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right of withdrawal from the contract is formalised. The deadline shall be deemed to have been met if the customer returns the product before the end of the period.

The customer shall bear the cost of returning the product.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Therefore, in order to avoid transport problems, please make sure that the package is properly protected and sealed. Once received, we will check its condition. As soon as we check that the item/s, as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid.

X. Refund of payment

The reimbursement of the amounts received by the customer will be made using the same means of payment used by the customer, unless otherwise stipulated. If the order has been paid by cash on delivery, the customer must indicate an account number to make the payment.

JOUMMA BAGS SL may withhold the refund until it has received the product, reason for withdrawal, or until the customer provides proof of return of the same, depending on which condition is met first.

In the event of unjustified delay on the part of JOUMMA BAGS SL, with respect to the refund of the sums paid, the customer may claim double the sums paid, without prejudice to the right to be compensated for damages suffered in excess of that amount.

XI. Return of the defective product.

JOUMMA BAGS SL will bear the cost of the return.

In the event that the product is not in good condition and the causes attributable to it are not the result of the customer, the customer will have the right to return the product, informing JOUMMA BAGS SL of the reason for return through any of the means provided in these conditions of contract, and at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.

JOUMMA BAGS SL undertakes to assume the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

XII. Jurisdiction.

Likewise, JOUMMA BAGS SL reserves the right to bring any civil or criminal action it deems appropriate for improper use of its website and content or for breach of these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any controversy arise, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
